What is a medical opinion?

A medical opinion is a medical document, equivalent to sworn testimony in court, written by a medical expert in the relevant field, relating to an incident and alleged damage in the medical field.


In such a document, the expert medically reviews the event, examines the complainant, discusses the medical problems that existed before the event, and discusses the actions taken by the treating physician. Finally, the expert writing the opinion provides their professional assessment regarding the course of the event, the conduct of the medical team, whether there was any failure in the medical conduct, and whether any physical or mental damage remains in the complainant. If there is permanent damage that is unreasonable under the circumstances of the case, the expert may rule that the complainant deserves a determination of disability percentages.

There are several situations in which a private individual will require a medical expert opinion: one, when they have suffered damage due to an injury to the mouth and teeth, and the other, when they suspect that they have undergone or received defective medical treatment. According to the law, in order to file a medical claim before a court, it must be submitted with a medical expert opinion prepared by a doctor, an expert in their field. In the first case, the expert's work is relatively easy. They must assess the damage and the costs and treatments involved in restoring the situation to its former state as much as possible, as well as assess the ongoing maintenance needs for the rest of their life.


The second case is much more complex. In this type of expert opinion, the doctor who performs and advises on the subject of the opinion must know how to distinguish between "treatment that failed,"

error in judgment, and "an action that the doctor explained or the accepted practice would have acted upon or refrained from" - according to the context - and according to this distinction, navigate the expert opinion.
